Takamiya Group Global Privacy Policy

Takamiya Co., Ltd. (“Takamiya”) and its group companies (collectively, the “Takamiya Group” or “we”) will strive to carefully handle:
-personal information (meaning the personal information as defined by applicable national laws and regulations.); 

that may be provided to us by our customers, business partners, shareholders, employees, etc. (collectively, “you”) and thereby protect your privacy. 
The definitions and interpretations of the terms used in this Takamiya Group Global Privacy Policy (this “Global Policy”) shall be in accordance with the laws, guidelines, and other regulations regarding the protection of personal information in the applicable countries, except as otherwise defined or interpreted in this Global Policy.

Furthermore, the Takamiya Group as defined in this Global Policy shall mean the corporations specified in Sections “10. Special provisions based on the Personal Information Protection Law (3)②” below.

1.Compliance with Related Laws, Regulations, Guidelines, etc.
The Takamiya Group will lawfully and properly handle personal information in compliance with the Act on the Protection of Personal Information (the “Personal Information Protection Act”) and other related laws and regulations, relevant guidelines prescribed by the Personal Information Protection Commission, and the like, as well as in compliance with this Global Policy.

2.Acquisition of Personal Information
The Takamiya Group will acquire your personal information by lawful and proper means.

3.Purposes of Use of Personal Information
The Takamiya Group will use your personal information within the scope necessary to achieve the following purposes of use and will not use your personal information for any other purpose, unless you have given us your consent to do so, or unless otherwise prescribed in applicable laws or regulations.

•To ship catalogs, goods, etc. and carry out related business activities
•To manufacture goods, engage in rental business, or provide services such as designing of contracted work, construction work or temporary facility work, and transportation services

•To improve the quality of telephone responses and prevent problems

•To provide information to applicants in employment/recruitment activities and conduct personnel and safety management and related business activities after the hiring of applicants

(6)Personal information pertaining to related parties other than those listed above
•To process administrative work in relation to improving the quality of telephone responses and preventing problems
•To conduct statistical surveys, questionnaire analyses and marketing activities for the development of products and improvement of services, and carry out business activities such as the provision of information concerning goods and services  
•To perform agreements and otherwise process administrative work to properly and smoothly perform transactions with related parties

4. Disclosure and Provision of Personal Information to Third Party
The Takamiya Group will not, without good cause, disclose and provide personal information to any third party except with the consent of the subject individual, or as provided by law or otherwise.

5.Management of Personal Information and Personal Data
(1) Ensuring data accuracy
The Takamiya Group will maintain your personal data in an accurate and up-to-date state, within the scope necessary to achieve the purposes of use thereof, and will strive to erase such personal data when it is no longer necessary for us to use the same.

(2) Safety management measures
We will strive to further develop internal regulations and take safety measures within the Takamiya Group so as to prevent and correct any unauthorized access to, divulgation or loss of, or damage to, your personal data.
Our safety management measures are specifically set forth in our separate Regulations for Handling of Personal Information and Specific Personal Information, the outline of which is as follows:
(Development of basic guidelines for protection of personal information)
To ensure the proper handling of personal data, we have developed these basic guidelines regarding matters such as compliance with relevant laws, regulations and guidelines, etc. and contact places that will handle the questions and complaints received.
(Organizational safety-management measures)
In addition to establishing managers who are responsible for the handling of personal data, we have developed a system to report and communicate, to the respective managers, any fact or sign of violation of the Personal Information Protection Act or our Regulations for Handling of Personal Information and Specific Personal Information, whenever such fact or sign is recognized.  
We regularly conduct self-inspections, and cause other departments and outside parties to conduct audits, of personal data handling statuses.
(Personnel safety-management measures)
We regularly provide training to employees regarding matters to be noted in relation to the handling of Personal Data.
Matters pertaining to confidentiality of personal data are as set forth in our respective work rules.
(Physical safety-management measures)
In areas where personal data are being handled, we take measures to restrict employees’ room entries/exits, and the carrying in of any equipment, etc., as well as to prevent any viewing of personal data by any unauthorized person.
We take measures to prevent any theft or loss, etc. of equipment, electronic media and documents, etc. that handle personal data, as well as measures to ensure that personal data is not easily known when such equipment, electronic media, etc. is being carried, including when moving the same within our business sites.
(Technical safety-management measures)
We implement access control to restrict the scopes of the persons in charge of handling personal data and the personal information files, etc. to be handled by them.
We have introduced a system to protect our information systems that handle personal data from any unauthorized access by an outside party or from any unauthorized software.

(3) Supervision of employees
When allowing our employees to handle your personal data, we will cause all of such employees to be thoroughly aware of the proper handling of personal information and properly educate them, and exercise necessary and appropriate supervision over them.

(4) Supervision of entrustees
In the event of entrusting the handling of your personal data, we will select, as our entrustee, a partner company that takes appropriate safety management measures, and we will exercise necessary and appropriate supervision over such entrustee.

6.Improvement Measures
The Takamiya Group will strive to accurately deal with changes in the social environment involved in the handling of personal information. We will also strive to improve our various internal regulations, including this Global Policy, such as by making changes, modifications or supplementations thereto whenever necessary.

If you have any complaints regarding our handling of personal information (including any complaint you may have regarding our acceptance or other handling of your statement of dissatisfaction concerning the measures taken by the Takamiya Group in respect of your Request for Disclosure, Etc.), please contact us at the contact points listed in below. We will strive to properly and promptly process any complaint received. Telephone calls are accepted at the respective contact points from 9:00 a.m. until 5:30 p.m. (but not on Saturdays, Sundays, national holidays and non-business days of Takamiya).

10. Special provisions under the Personal Information Protection Act
The handling of personal information(meaning the information defined in Article 2 of the Act on the Protection of Personal Information; and
- specific personal information (meaning the information defined in Article 2, Paragraph 8 of the Act on the Use of Numbers to Identify a Specific Individual in the Administrative Procedure) in accordance with the Personal Information Protection Act shall be governed by the provisions of 1. through 9. above and this section.

(1)Provision of Personal Data to Third Parties
As a general rule, the Takamiya Group will not disclose or provide to a third party any personal data received from you, unless:
•we have obtained your prior consent to do so
•the given circumstances fall under any of the exceptions provided for in Article 27, Paragraph 1, Items (i) through (iv) of the Personal Information Protection Act; or
•the given circumstances fall under any of the provisions of Article 27, Paragraph 2 (relating to opting out (excluding, however, any special care-required personal information)), or Article 27, Paragraph 5, Items (i) through (iii) (relating to outsourced handling, succession to business, and shared use, of personal data) of the Personal Information Protection Act

(2)Entrustment of Personal Data Handling
To promote our business activities in a smooth manner and provide you with services of a higher quality, we may entrust the handling of your personal data to a partner company (Article 27, Paragraph 5, Item (i) of the Personal Information Protection Act); provided, however, that such entrustment of the handling of personal data will be limited to the minimum extent necessary to carry out the entrusted work.

(3)Shared Use of Personal Data
To provide you with services of a higher quality by utilizing cooperation among the Takamiya Group companies hereunder, we will share the use of personal data in the manner described below. With regard to any shared use, etc. of personal data with Takamiya’s foreign group companies, etc., such personal data will separately be handled in a lawful and appropriate manner in accordance with the provisions of the Personal Information Protection Act and other relevant laws and regulations, etc.; provided, however, that the foregoing does not apply to any specific personal information, as this will not be subject to shared use.

①Method of making requests for disclosure, etc.; method of replying
(a)Method of making requests for disclosure, etc.
If either you or your agent wishes to make a request for notification regarding the purposes of use, or a request for disclosure, correction, supplementation, deletion, suspension of use, suspension of provision to third parties, or the like, in respect of your personal information retained by us (a “Request for Disclosure, Etc.”), please mail the documents, etc. necessary for making such request, as specified in “(2) Documents necessary for making a Request for Disclosure, Etc.,” to the respective contact points listed Sections “7.Processing of Complaints”. 
* Please mark the envelope with the wording “Containing Documents Relating to Request for Disclosure, Etc.” in red characters. Please be advised in advance that we do not accept any Request for Disclosure, Etc. which is made by telephone, email, facsimile, or a visit to any company. 
② Method of replying
We will properly respond to each Request for Disclosure, Etc. in accordance with applicable laws, regulations, etc., within a reasonable period pursuant to the Takamiya Group’s internal regulations (as a general rule, within two (2) weeks; however, a period of approximately thirty (30) days may be required if considerable time is necessary for us in responding to a request consisting of many items, or a complicated request, etc.). 
After receiving a Request for Disclosure, Etc., we will reply to such request either in writing or in the form of an electromagnetic record, within the aforementioned reasonable period, by way of restricted-recipient registered mail (special type), sent to the address specified on the request form. 
Even if your agent makes a Request for Disclosure, Etc. on your behalf, our reply to such request will be mailed via the method above, by designating you (the data subject), regarding whom such Request for Disclosure, Etc. has been made, as the recipient of the mail. However, in the case of a Request for Disclosure, Etc. made by your statutory agent, we will reply to your statutory agent. 
It should be noted that, if the information regarding which you intend to make a Request for Disclosure, Etc. does not fall under the “retained personal data” as defined in Article 2, Paragraph 7 of the Personal Information Protection Act, you will not be permitted to make such Request for Disclosure, Etc. 
③ Documents necessary for making a Request for Disclosure, etc.
In making a Request for Disclosure, Etc. as set forth in (1) above, you must print out a prescribed form as shown in (a) below and fill out all necessary items therein, and mail such form, attaching thereto your identification documents for personal identification as shown in (b) below, and the prescribed fees as shown in (c) below (such fees must be paid when you make a request for notification of the purposes of use, or a request for disclosure).

* An identification document must be issued by a public organization, such as the national government or the relevant local government, and must be within the effective period of use thereof. 
(c)Fees
You must pay fees if you are making a request for notification of purposes of use or a request for disclosure.
JPY 800 must be paid for each request form. Please pay such fees by enclosing the equivalent amount of postage stamps. For details of the fees involved, please see the “Matters to be Noted” section specified in the “Request for Notification of Purpose of Use of Retained Personal Data” and the “Request for Disclosure of Retained Personal Data” forms.
In making a Request for Disclosure, Etc., you will not be required to pay any fees for any request for notification of purposes of use, or any request for disclosure. However, you must pay the postage necessary in making such request to the relevant group company.
④Decisions on Disclosure, etc. or Non-Disclosure, etc.
In making our decision regarding each Request for Disclosure, Etc. received, we will take into account factors such as whether the request concerned: (a) fulfills legal requirements; (b) does not involve any procedural flaws; and (c) is made in relation to information falling under “retained personal data.” 
Upon completing all or part of our measures taken in respect of your Request for Disclosure, Etc., or upon reaching a decision that we are unable to comply with your Request for Disclosure, Etc., we will mail you our reply to such effect without delay. Please be advised in advance that any fees which you have already paid will not be refunded even if we are unable to comply with your request for notification of the purposes of use or your request for disclosure.
⑤ Purposes of use of personal information acquired in connection with any Request for Disclosure, etc.
Your personal information contained in any of the forms shown in ①(a) above will only be used to the extent necessary for us to process our responses to the relevant Request for Disclosure, Etc. received from you (namely, in carrying out investigations concerning the relevant Request for Disclosure, Etc., confirming your identity or the identity of your agent, and replying to such request).

11. Special provision under GDPR and CCPA
Our GDPR Privacy Policy supersedes this Global policy with respect to the treatment of personal data concerning data subjects in the Member States of the European Union and the three EEA/EFTA countries Iceland, Liechtenstein, Norway and the United Kingdom and;
― Our CCPA Privacy Policy supersedes this Global policy with respect to the handling of personal information regarding California residents in the United States of America.

12.Revision of this Global Policy
We will comply with the laws, regulations, etc. that apply to the handling of personal information and suitably review the details of this Global Policy, and we may amend this Global Policy whenever necessary. In such case, this Global Policy after amendment will apply starting from the day on which such revised version is made public.
